Whenanapplicationfortheregistrationofatrade-markisbasedontheintentionto
usethetrade-markinCanada,onemustfirstfileadeclarationwhichstatesthatthe
applicanthascommenceduseofthetrade-markinCanada,inordertoobtainthe
registration.Paragraph40(2)oftheTrade-marksActstatesthefollowing

Canada,inassociationwiththewaresor
servicesspecifiedintheapplication,hasbeen
commencedby
(a)theapplicant;
(b)theapplicant’ssuccessorintitle;or
(c)anentitythatislicensedbyorwiththe
authorityoftheapplicanttousethetrade-
mark,iftheapplicanthasdirectorindirect
controlofthecharacterorqualityofthewares
orservices.

anapplicationforregistrationisfiledon2008-01-01butiftheregistrationisonly
allowedon2012-01-01(morethanthree(3)yearsofthedateoffilingofthe
applicationforregistration),theapplicantwillhaveuntil2012-07-01(six(6)monthsof
thedatefromwhichtheregistrationwasallowed)tofilethedeclarationofuse.

Thus,avaguestatementsuchas“Wehavebeeninformedthattheapplicantcannot
filethedeclarationofuseprovidedforbyparagraph40(2)oftheActbecausethe
trade-markisnotyettotallyusedinCanadawithrespecttoallthemerchandiseand
serviceswhicharementionedintheapplicationforregistration”,isinsufficient.The
registrarhasrevised/standardisedhisfilingpolicyandonemust,sinceApril14,
1998,provideatruereasonfortheextension
16andnotsimplystatethatthemarkis
notyetusedandthatmoretimeisneededtocommercialiseitinCanada17.During
thefirstthree(3)years,whichfollowtheperiodwhenregistrationisallowed,this
reasondoesnotneedtobe“significantandsubstantial”;however,onemust
nonethelessbeprovided

justifyanextensionofthetimelimit?TheAct,therulesandthedirectivesaresilent.
However,itisinterestingtonotethat,intheUnitedStates,theUSPTOindicatesthat,
withrespecttothecommercialisationeffortsthatmustbeallegedbyanapplicant
whofindshimselfinasimilarsituation
22,willberecognised23,inanonexhaustive
manner,thefollowingreasons:
Thoseeffortsmayinclude,withoutlimitation,productorservice
researchordevelopment,marketresearch,manufacturingactivities,
promotionalactivities,stepstoacquiredistributors,stepstoobtain
requiredgovernmentalapproval,orothersimilaractivities.Inthe
alternative,asatisfactoryexplanationforthefailuretomakesuch
effortsmustbesubmitted

Theseveringofadistribution/licensingcontract,thebankruptcyofadistributor,a
largenumberofmerchandiseorservices,aspecialisedmarketorhighendproducts,

STANDARDTIMELIMITEXTENSION
Thestandardtimeextensionisofsix(6)months.However,whentheuseofthemark
isdelayedbecausetheapplicantisawaitingagovernmentapproval
