Amazon.com’s 1-click Patent Application is Finally Accepted
After a long judicial battle, Amazon.com which was seeking to patent a business method corresponding to its 1-click online shopping concept saw its patent application accepted in Canada just prior to Christmas.
The Canadian Patent Office had initially rejected Amazon.com’s patent application on the basis that it did not constitute patentable subject matter in Canada. A judgment from the Canadian Federal Court of Appeal in November 2011 had returned the file to the Patent Office to be reexamined in view of criteria on what constitutes patentable subject matter established by the Court of Appeal and rejecting the test initially established by the Patent Office.
An upcoming edition of our Newsletter will have more details of the initial implications of this development favorable towards the patentability of business methods in Canada.
