Landmark Victory for ROBIC in a Case Concerning a “Turnkey” Agreement and Loss of Future Profits

The six-year judicial saga, including a twenty-nine day trial involving Polteco Inc and three other Defendants, all represented by ROBIC’s Hugues G. Richard and Alexandra Steele, has come to an end as judgment was recently issued in the case of Tecsult inc. v. Polteco Inc. et al. (C.S.M. 500-17-022764-040).
The case dealt with the enforcement of a contract. The issues in
litigation were: what is the intensity of the obligations resulting
from the contract binding the parties? Did the engineers satisfy their
contractual and legal undertakings? If so, is Plaintiff entitled to its
unpaid fees? If not, are there direct, certain and foreseeable damages
for the Defendants?
